The Louisiana Citizens Protection Act is HB411 by Rep. Ernest Wooten. This is a comprehensive immigration enforcement bill modeled after the Arizona legislation, only it is even stronger. It will put Louisiana at the forefront of TRUE immigration reform.

Also attached to this bill is a provision to require full and fair disclosure on Shariah-Compliant mutual funds which are often currently marketed with no mention of their association with Shariah. With this provision, Rep. Wooten will be setting a model for other states to use to alert investors to certain mutual funds that are marketed as “ethical investing,” but are in reality Shariah-Compliant and governed by foreign Shariah scholars. Currently there are 4 mutual fund families that fall into this category.

Hearings for HB411 will be held on June 1st before the House Labor and Industrial Relations Committee. The key members of the committee are listed below. PLEASE CONTACT THEM BY EMAIL AND TELEPHONE AND ASK THEM TO SUPPORT HB411.

Influx of ‘birth tourism’ from Asia prompts Vitter bill to reform statute

(Washington, D.C.) - U.S. Sens. David Vitter (R-LA), Rand Paul (R-KY), Mike Lee (R-UT), and Jerry Moran (R-KS) this week introduced legislation that amends the Immigration and Nationality Act in order to limit birthright citizenship to children born in the U.S. to at least one parent who is a U.S. citizen, legal resident alien or active member of the U.S. armed forces.

“America’s illegal immigration problem is clearly out of control. Recent news reports have highlighted the growing popularity of ‘birth tourism,’ and new websites are advertising birth packages for pregnant foreign visitors who want to give birth in the United States to ensure automatic citizenship for their newborn children,” said Sen. Vitter. “This practice is not mandated by federal law or the Constitution but is based on what I believe is a fundamental misunderstanding of the 14th Amendment. This policy is incompatible with both the text and the legislative history of the citizenship clause.”

Several months ago, Haiti was hit by a devastating earthquake that disrupted their already dysfunctional third-world society. The crisis in Haiti has only been amplified over the months since the earthquake. Still barely recovering from the aftershocks, Haiti was struck by a cholera epidemic. The death toll from the plague has topped 1,000 people. In the midst of combating both the earthquake and the epidemic, Hurricane Thomas struck Haiti in October, killing 9 Haitians and causing widespread flooding that perpetuated the spread of cholera.

In the aftermath of the earthquake, government officials seemed all too willing to show their sympathy to the Haitian people. Many travelled all the way to Haiti to observe the disaster and meet with the victims. They also allowed 1200 Haitian orphans to seek refuge in the United States with the understanding that the children would be granted permanent residence. Representative Jeff Fortenberry (R-NE) authored the Help Haiti Act for the purposes of expediting the process.

Receiving extensive bipartisan support, the Help Haiti Act was passed through the House and the Senate, and after being amended in the Senate, the bill was placed on the agenda for this week’s legislative session. However, Pelosi, citing “scheduling considerations,” tabled the bill on Monday. Session continued on Tuesday, Wednesday, and Thursday with no sign of the bill being mentioned for consideration.

Word in the Halls of Congress is that Democrats wish to attach the Help Haiti Act to the controversial DREAM Act in order to make it more palatable for Republicans considering opting out of a Senate filibuster. Fortenberry addressed his colleagues in a letter, citing his concern over Pelosi’s “scheduling”:

I write to express my concern with circumstances preventing H.R. 5283, the Help HAITI Act, from coming to the Floor for a vote. I returned to Washington on Monday, anticipating the House to act to give vulnerable Haitian orphans and their adoptive American families, who have endured so much heartbreak and tragedy, the comfort of knowing they are here to stay. My bipartisan measure, the Help HAITI Act, was originally passed by the House on July 20, 2010, then was amended and passed by the Senate on August 4, 2010. I, along with numerous colleagues and members of the international adoption community, was pleased to see its inclusion on Monday’s suspensions list.

I was then surprised when it was pulled from legislative business on Monday, and with the consequent secrecy about its current status. My office has heard reports that this critical legislative fix, which would clear legal obstacles to U.S. citizenship for as many as 1200 Haitian orphans who were in the process of being adopted before the January 12 earthquake, may be used as a vehicle for a controversial immigration measure.

However, this past Thursday, Harry Reid announced his desire to introduce the bill on the senate floor. In the event of a senate introduction, the concern that the Help Haiti Act would be attached to the DREAM Act would disappear. But in the unfortunate case that the Help Haiti Act is written in with the DREAM Act, the decision for GOP representatives is a simple “no.” We cannot allow the DREAM Act to pass, and if necessary, the GOP must postpone legislation on the Help Haiti Act until 2011. It is unfortunate that the Haitian ethnicity is not a large enough minority demographic to merit the attention of Congressional Democrats. They would much prefer to use Haitian orphans as political collateral to establish a powerful liberal voting bloc through the passage of the DREAM Act.

Pedro Ramirez is the student body president at Fresno State University. By all accounts, Pedro is a well respected student and a hard working member of society. The only problem is that Pedro has never had a job in his life. Because he doesn’t have a social security number, and he is not a citizen of the United States.

Of course, this minor stipulation is perfectly acceptable by the left-wing nutjobs who run California, and it is also perfectly acceptable for Fresno State University officials who have supported Pedro’s bid for student body president and his “right” to continue to receive an education in the United States.

Before going any further, it should be pointed out that Ramirez was smuggled into the United States by his parents when he was 3 years old. He is obviously not someone who should be entirely blamed for the current scandal. He was put in this position by his parents who decided to violate the laws of the United States to serve their own self-interest. Now, Ramirez has been put in a position to lose everything that he has worked for, when the reality is that he never should have had any of it to begin with.

The revelation of Pedro’s status as an undocumented immigrant came in the aftermath of his election as student body president. The president is allotted a stipend of $9,000 for serving the student body. On receiving the news that he had earned such a sizable stipend– it is reported that he was unaware of the stipend– he alerted school officials of his illegal status and declined the money on those grounds. However, some administrators knew of his illegality prior to this scandal, as Ramirez was required to submit proper documentation to the college in order to gain acceptance as a freshman. They allowed him to attend the university.

His opposition in the student government race discovered his illegal status and submitted the story to the school newspaper, where the information was published and the controversy unleashed. Here is a statement from school officials:

School administrators said Ramirez broke no rules by running for president of Associated Students Inc.

“To our way of thinking he hasn’t done anything wrong,” said Paul Oliaro, vice president for Student Affairs.

“This is a very diverse region, agriculture is dominant, and this is going to cause a lot of controversy. But the reality is that these students are … here, they’re legitimate students, and if anything, Pedro shows what they can contribute,” Oliaro said, adding, “We’ll see how this plays out.”

Yes, the reality is that the students are here, but also, the reality is that California state officials allow them to be here with rulings like Monday’s mandate by the California State Supreme Court:

On Monday, the California Supreme Court decided unanimously that illegal immigrants who graduated from state high schools can continue to receive lower, in-state tuition at California’s public universities and colleges. It’s the first state Supreme Court ruling of its kind in the nation.

The case was brought on behalf of citizens who are paying the higher out-of-state tuition rates. The group contended that lower tuition could not be offered to illegal students and denied to some citizens.

So, an illegal immigrant is allowed to take advantage of benefits that regular citizens are denied. Legitimate citizens of this country are require to pay higher tuition rates than illegal Mexicans. It almost makes me want to throw up. These kinds of ridiculous hard left decisions are not only completely wrong in a constitutional sense, but they put hard working American citizens at an unfair disadvantage to illegal immigrants who have never held a job in their life…

And why should Ramirez step down? Why should he voluntarily leave the state, leave the country? The inability of the state to enforce the laws in place allows illegals to take advantage of benefits they do not deserve. If you can manage to get through high school without being discovered, you can go ahead and take advantage of benefits designated for U.S. citizens. Here is a statement from a Steve Camarota, advocate for an organization supporting immigration reform:

“Why should he step down?” Camarota said. “He’s very clearly gotten the message that immigration law doesn’t matter — you can violate it with impunity.”

Why indeed? This situation is one in which the entire slate of American citizens should be calling out in disgust. Latinos included. How do you think legal immigrants and home born Hispanic citizens feel about an illegal immigrant taking advantage benefits reserved for legitimate citizens? I can tell you that all legal citizens of this country should be disgusted with the handling of this situation.

And then there are these statements from Ramirez, who seems to not understand that he violated United States laws:

“In a way, I’m relieved,” said Ramirez, a 22-year-old political science major from Tulare, Calif. “I don’t want to be a liability or cost the school donations. I never really thought this was going to happen. But now that it’s out there, I finally feel ready to say ‘Yes, it’s me. I’m one of the thousands.’ “

“Could you leave my parents out of it?” he asked. “They’ve done everything for me.”

Is this kid for real??? He’s not 3 years old anymore, so this kind of ignorance is somewhat inexcusable. However, it probably can be somewhat attributed to the indoctrination of California society, which allows illegals to violate the laws of our nation unhindered. Obviously, this type of government sends to wrong message, and clearly Ramirez has decided to join them in evading the reality of the situation.

Leave you parents out of it? They’ve given you everything? Look it’s tough that you have achieved a level of success in America, but it was done illegally. It’s an illusion. His parents didn’t give him anything but an illusion of success and the probability that this success would be stripped away in an instant. Ramirez isn’t losing anything, because he was never entitled to anything in the first place.

And of course, hovering in the shadows behind all of this controversy is Harry Reid’s infamous Dream Act. The Democrats of the current lame-duck session have promised to push for a vote on the Dream Act before the new congressmen enter into session in 2011. Ramirez is a member of an organization called the Dream Network:

He is also involved in the Dream Network — an organization of undocumented students working for passage of the Dream Act, a proposed federal law that would allow students living in the U.S. illegally to earn legal status if they graduate from high school and complete two years in college or the military.

How about the Democrats actually focus on the issues that affect legal American citizens? Like perhaps the Bush Tax Cuts? Maybe, cutting government waste? Maybe, stimulating the private sector by reducing regulations on things like domestic energy production? But no, the Democrats are committed to forcing a vote that grants illegal residents of this country the opportunity steal benefits from hardworking Americans.

Ramirez has repeatedly spoken of his aspiration to achieve the “American Dream.” One problem: the American Dream is reserved for Americans. If you are a legal citizen of this country, you are entitled to work for success and the achievement of the American Dream. If you are not a legal resident of the United States, you are not entitled to achieve that success. The Left has adopted this untenable perception that the American Dream applies to all people in our country regardless of their legality, and this perception is simply not fair and not acceptable. It’s hard enough to work for the American Dream as a citizen of this country, but when illegals come into our country and take opportunities from hardworking Americans there is no opinion in the entire world that can convince me this is acceptable.

Sen. Jeff Sessions put out the following release this morning on the DREAM Act, the illegal-alien amnesty bill Harry Reid is trying to pass through the lame-duck Senate. According to Michelle Malkin, several Republican Senators are reportedly still on the fence about whether they’ll join the filibuster of the legislation – John McCain (who ran as an immigration hawk in the GOP primary against J.D. Hayworth), Olympia Snowe and Susan Collins, Lisa Murkowski, Sam Brownback, Kay Bailey Hutchinson and George LeMieux.

Ten Things You Need To Know About S.3827, The DREAM Act

1. The DREAM Act Is NOT Limited to Children, And It Will Be Funded On the Backs Of Hard Working, Law-Abiding Americans

Proponents of the DREAM Act frequently claim the bill offers relief only to illegal alien “kids.” Incredibly, previous versions of the DREAM Act had no age limit at all, so illegal aliens of any age who satisfied the Act’s requirements—not just children—could obtain lawful permanent resident (LPR) status. In response to this criticism, S.3827 includes a requirement that aliens be under the age of 35 on the date of enactment to be eligible for LPR status. Even with this cap, many aliens would be at least 41 years old before obtaining full LPR status under the Act—hardly the “kids” the Act’s advocates keep talking about.

The DREAM Act requires that DHS/USCIS process all DREAM Act applications (applications that would require complex, multi-step adjudication) without being able to increase fees to handle processing. This mandate would require either additional Congressional appropriations, or for USCIS, a primarily fee-funded agency, to raise fees on other types of immigration benefit applications. This would unfairly spread the cost of administering the DREAM Act legalization program among applicants and petitioners who have abided by U.S. laws and force taxpayers to pay for amnesty. Taxpayers would also be on the hook for all Federal benefits the DREAM Act seeks to offer illegal aliens, including student loans and grants.

2. The DREAM Act PROVIDES SAFE HARBOR FOR ANY ALIEN, Including Criminals, From Being Removed or Deported If They Simply Submit An Application

Although DREAM Act proponents claim it will benefit only those who meet certain age, presence, and educational requirements, amazingly the Act protects ANY alien who simply submits an application for status no matter how frivolous. The bill forbids the Secretary of Homeland Security from removing “any alien who has a pending application for conditional status” under the DREAM Act—regardless of age or criminal record—providing a safe harbor for all illegal aliens. This loophole will open the floodgates for applications that could stay pending for many years or be litigated as a delay tactic to prevent the illegal aliens’ removal from the United States. The provision will further erode any chances of ending the rampant illegality and fraud in the existing system.

3. Certain Criminal Aliens Will Be Eligible For Amnesty Under The DREAM Act

Certain categories of criminal aliens will be eligible for the DREAM Act amnesty, including alien gang members and aliens with misdemeanor convictions, even DUIs. The DREAM Act allows illegal aliens guilty of the following offenses to be eligible for amnesty: alien absconders (aliens who failed to attend their removal proceedings), aliens who have engaged in voter fraud or unlawfully voted, aliens who have falsely claimed U.S. citizenship, aliens who have abused their student visas, and aliens who have committed marriage fraud. Additionally, illegal aliens who pose a public health risk, aliens who have been permanently barred from obtaining U.S. citizenship, and aliens who are likely to become a public charge are also eligible.

4. Estimates Suggest That At Least 2.1 Million Illegal Aliens Will Be Eligible For the DREAM Act Amnesty. In Reality, We Have No Idea How Many Illegal Aliens Will Apply

Section 4(d) of the DREAM Act waives all numerical limitations on green cards, and prohibits any numerical limitation on the number of aliens eligible for amnesty under its provisions. The Migration Policy Institute estimates that the DREAM Act will make approximately 2.1 million illegal aliens eligible for amnesty. It is highly likely that the number of illegal aliens receiving amnesty under the DREAM Act will be much higher than the estimated 2.1 million due to fraud and our inherent inability to accurately estimate the illegal alien population. Clearly, the message sent by the DREAM Act will be that if any young person can enter the country illegally, within 5 years, they will be placed on a path to citizenship.

5. Illegal Aliens Will Get In-State Tuition Benefits

The DREAM Act will allow illegal aliens to qualify for in-state tuition, even when it is not being offered to U.S. citizens and legally present aliens living just across state lines. Section 3 of the DREAM Act repeals Section 505 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1623) which prohibits giving education benefits to an unlawfully present individual unless that same benefit is offered to all U.S. citizens.

6. The DREAM Act Does Not Require That An Illegal Alien Finish Any Type of Degree (Vocational, Two-Year, or Bachelor’s Degree) As A Condition of Amnesty

DREAM Act supporters would have you believe that the bill is intended to benefit illegal immigrants who have graduated from high school and are on their way to earning college degrees. However, the bill is careful to ensure that illegal alien high school drop-outs will also be put on a pathway to citizenship – they simply have to get a GED and be admitted to “an institution of higher education,” defined by the Higher Education Act of 1965.

Under the Higher Education Act, an “institution of higher education” includes institutions that provide 2-year programs (community colleges) and any “school that provides not less than a 1-year program of training to prepare students for gainful employment” (a vocational school). Within 8 years of the initial grant of status, the alien must prove only that they finished 2 years of a bachelor’s degree program, not that they completed any program or earned any degree.

If the alien is unable to complete 2 years of college but can demonstrate that their removal would result in hardship to themselves or their U.S. citizen or LPR spouse, child, or parent, the education requirement can be waived altogether.

7. The DREAM Act does not require that an illegal alien serve in the military as a condition for amnesty, and There is ALREADY A Legal Process In Place For Illegal Aliens to Obtain U.S. Citizenship Through Military Service

DREAM Act supporters would have you believe that illegal aliens who don’t go to college will earn their citizenship through service in the U.S. Armed Forces. However, the bill does not require aliens to join the U.S. Armed Forces (the Army, Navy, Air Force, Marine Corps, or Coast Guard); instead it requires enlistment in the “uniformed services.” This means that aliens need only go to work for the National Oceanic and Atmospheric Administration or Public Health Service for 2 years to get U.S. citizenship. If the alien is unable to complete 2 years in the “uniformed services,” and can demonstrate that their removal would result in hardship to themselves or their U.S. citizen or LPR spouse, child, or parent, the military service requirement can be waived altogether. Such claims will likely engender much litigation and place a huge burden on DHS.

Furthermore, under current law (10 USC § 504), the Secretary of Defense can authorize the enlistment of illegal aliens. Once enlisted in the U.S. Armed Forces, under 8 USC § 1440, these illegal aliens can become naturalized citizens through expedited processing, often obtaining U.S. citizenship in six months.

8. Despite Their Current Illegal Status, DREAM Act Aliens Will Be Given All The Rights That Legal Immigrants Receive—Including The Legal Right To Sponsor Their Parents and Extended Family Members For Immigration

Under current federal law, U.S. citizens have the right to immigrate their “immediate relatives” to the U.S. without regard to numerical caps. Similarly, lawful permanent residents can immigrate their spouses and children to the U.S. as long as they retain their status. This means illegal aliens who receive amnesty under the DREAM Act will have the right to immigrate their family members—including the parents who sent for or brought them to the U.S. illegally in the first place—in unlimited numbers as soon as they become U.S. citizens (6 to 8 years after enactment) and are 21 years of age.

Additionally, amnestied aliens who become U.S. citizens will be able to petition for their adult siblings living abroad to immigrate to the U.S., further incentivizing chain migration and potentially illegal entry into the United States (for those who don’t want to wait for the petition process overseas). When an adult brother or sister receives a green card, the family (spouse and children) of the adult sibling receive green cards as well.

9. Current Illegal Aliens Will Get Federal Student Loans, Federal Work Study Programs, and Other Forms of Federal Financial Aid

Section 10 of the DREAM Act allows illegal aliens amnestied under the bill’s provisions to qualify for federal student assistance under Title IV of the Higher Education Act of 1965 (20 U.S.C. 1001 et seq.) in the form of federal student loans (Stafford Loans, Perkins Loans, Federal Direct Stafford/Ford Loans), federal work-study programs, and other federal education services such as tutoring and counseling.

10. DHS Is Prohibited From Using the Information Provided By Illegal Aliens Whose DREAM Act Amnesty Applications Are Denied To Initiate Their Removal Proceedings or Investigate or Prosecute Fraud in the Application Process

When an illegal alien’s DREAM Act amnesty application is denied, the bill states that the alien will revert to their “previous immigration status,” which is likely illegal or deportable. The bill, however, prohibits using any of the information contained in the amnesty application (name, address, length of illegal presence that the alien admits to, etc) to initiate a removal proceeding or investigate or prosecute fraud in the application process. Thus, it will be extremely hard for DHS to remove aliens who they now know are illegally present in the U.S., because illegal aliens will be able to claim that the legal action is a product of the amnesty application, and DHS will have the nearly impossible task of proving a negative.

Let’s just get one thing straight right off the bat. Rubio is the son of a Cuban immigrant. In other words, his father is a member of the Latino population moderator Greg Hengler claims Rubio is discriminating against. From the outset, the accusation is astoundingly ignorant.

But then let’s get to the real meat of the matter. No one from The Left has the capacity to understand that enforcing our country’s immigration laws is not anti-Latino. It is called upholding the laws of the United States of America. It is called being pro-America, and any Latino-American who has immigrated to this country legally supports the enforcement of immigration laws. Period.

Here is a statement from Hotair on the issue:

It seems to escape the intellectual capacity of Rubio’s opponents, and many on the Left, that one can be pro-immigration while demanding and end to illegalimmigration. Marco Rubio makes this point very clearly and concisely by demanding the rule of law apply not just to Americans but also those who want to enter our country. It’s hardly anti-Latino to demand equal treatment under the law, and to demand that the federal government fulfill one of its actual Constitutional duties in securing the nation’s borders.

Hotair places the issue in its proper context. Supporting the enforcement of illegal immigration laws is not anti-Latino. It is supporting a constitutional mandate of the federal government. On the issue of illegal immigration, The Left could not be more in the wrong. The flawed logical of left-wing politicians on this issue is quite apparent in every corner of the country. Maybe its time The Left starts appealing to legal citizens of this country, because if they really want to obtain the vote of legitimate Latino-Americans, they’re not going to succeed by taking such an obviously flawed stance.

Ruth McClung is an actual rocket scientist at an engineering company in Tucson and a true conservative. She’s the Republican challenger to Democrat Raul Grijalva, who made waves earlier this year in endorsing a boycott of his own state following the passage of Arizona’s immigration enforcement law.

And according to a Magellan Strategies poll of the race, despite having only $16,000 in the bank she’s in a dead heat with Grijalva. The McClung campaign’s internal numbers say she’s actually leading the incumbent 39-37.

Magellan’s numbers indicate by a 50-36 the voters would like to give someone else a chance, and he’s underwater on his approval ratings by a 49-37 count.

Grijalva has about $80,000 in the bank and he’s running TV spots for the first time in eight years. The Congressional Hispanic Caucus is trying to decide whether to put some money behind him when several other members of its ranks are in similar trouble.

This is a seat which was considered an easy Democrat hold. It isn’t.

You can donate to Ruth’s campaign here.

UPDATE: Maybe this has something to do with why McClung is on the way up:

UPDATE #2: Sarah Palin has endorsed McClung…

Ruth McClung is the smart choice for Congress in southwestern Arizona. It doesn’t take a rocket scientist to know that our country is on the wrong track under the leadership of Obama, Pelosi, and Reid; but Ruth actually is a rocket scientist! Ruth’s commonsense fiscal approach to job creation and reining in reckless government spending is in sharp contrast to her opponent’s liberal record.

The Left is arguing that those of Dominican descent can’t possibly be thinking any differently about immigration than Mexicans who cross the border illegally. How could a Puerto Rican think any differently about immigration than an illegal immigrant from El Salvador, the Left would theorize. Liberals might as well just say Hispanics all look alike and speak the same language, so they all share the same concerns.”

This appraisal of the Democratic attitude towards immigrants is what establishes their misperception of the entire constituency. The fact is, not all Hispanics are opposed to immigration restrictions. Actually, the split of Hispanics between pro-immigration policy and anti-immigration policy is roughly 50-50.

This trend is displayed in the data delivered by the Las Vegas Review-Journal, polling registered voters in Nevada. When asked whether citizens believed illegal immigrants had a positive or negative effect on Nevada, 43% of Hispanics said the effect was negative compared to 45% who believed it was positive. A roughly 50-50 split.

Further proof that the constituency is up for grabs? Let’s look at the breakdown of the Hispanic vote on recent major anti-immigration referenda Arizona as cited by CNN exit polls and Latino voter research data:

Arizona Proposition 103- Declaring English as the Official Language: 48% of Hispanics FOR

Arizona Proposition 300- Preventing Illegals from Receiving Public Benefits: 40% of Hispanics FOR

Also in Arizona, 41% of Hispanics voted for incumbent Sen. Jon Kyl, R-Ariz., who made illegal immigration a central campaign issue.

Another post recently about Harry Reid’s Dream Act also underlines this fact: you can find it here.

The problem for liberals is that in their extreme effort to appeal to minorities they have conceived a fatal error. Their activism in opposition to immigration laws has alienated large groups of Hispanic Americans who do not associate themselves with Mexican immigrants. Grouping all Hispanics into one voting bloc, and giving this group a generalized label based on perceptions of the Hispanic mindset has effectively alienated Hispanics from the Democratic Party.

Now, consider, as my previous post stated, that the discrepancy between Hispanics likely to vote Democrat and those likely to vote Republican has narrowed significantly. The relevance of this statistic is that the traditionally high percentage of Hispanic Democrats compared to Hispanic Republicans has shrunk. Today, empirical evidence proves that Hispanic voters are trending away from the Democratic Party. All Republicans have to do is stick to their guns and count on the left-wing activists to keep pushing that constituency further to the right. Just like everything else in this election, Republicans don’t have to do anything but claim to be different from Democrats. Because that’s all people want in Congress…non-Democrats.
