Patrick Leahy Proves Shakespeare Right

It seems lawyers, specifically those holding elected office, sought elected office because they’re too incompetent to understand the Constitution.

Senator Patrick Leahy (D-VT), Senate Judiciary Committee Chairman  is a graduate of the prestigious law center at Georgetown University. He’s held his shingle since 1964. It apparently needs the bird poop washed off of it. He thinks the Supreme Court of the United States (SCOTUS) should automatically defer to Congress concerning the constitutionality of laws pushed down the nation’s throat (or more accurately shoved UP from the other direction) in the form of the Affordable Care Act aka ObamaCare.

Of course that deference to Congressional mandate should only be employed for Democrats. Liberalism’s the only political ideology deserving such reverential submissiveness. Leahy believes his ideals are the only ones acceptable as viewed from his sub-throne at the left rear acreage of Obama’s sovereign realm.

Obama started this absurdist pap when he (another freakin’ lawyer) said the same thing; that for the SCOTUS to reverse a “popular” legislative act passed by elected officials would be wrong. He said the SCOTUS holds incredible power but is NOT elected. Obama continued “… it’s precisely because of that extraordinary power that the court has traditionally exercised significant restraint and deference to our duly elected legislature, our Congress”

So let me see if I have this right. All of the stuff we were taught in Civics Class about a tripartite government with three (3) equally powerful branches balancing the activities of the other was a lie? These lawyers think so and have NO fear whatsoever of stating it and trying to intimidate the SCOTUS into giving in to only one political ideology: theirs.

The only hope the American people have is in the political restraint the SCOTUS is charged to use when adjudicating the propriety of laws tested before the bench. Only SCOTUS has the power to short-circuit the tyranny of the elite. If the court must “defer” to Congress, there’s no need for the court. The American Dream will plummet from the heights as a beacon of fairness, impartiality and even-handedness in its dealing with its people. Tyranny can easily supplant democracy based republicanism which is a form of government: not an ideology.

If these two (Obama and Leahy) are examples of what the legal profession’s dropped to I fear for the nation, let alone the world because these guys have NO idea what they’re talking about. People like them drop university diplomates to the level of diploma mill customers and charlatans.

I have a 15 year old son. If he ever tells me he wants to attend Georgetown or Harvard Law School, I’ll suggest Wally’s School o’ Law and Dry Cleaning Emporium for his sheepskin. It’ll display as much substantive value as Obama’s and Leahy’s appear to hold.

Shakespeare may have said it best in Henry the VI when Dick the Butcher makes his statement: “…the first thing we do is kill all the lawyers.” It’s not suggested any violence should be brought against attorneys. But it would be nice to inject a little humility counteracting the supreme hubris Obama and Leahy display.

Lawyers elected to government office denote no greater life knowledge than the average citizen. They do belong to a closed shop requiring a specific vocabulary and diction designed to confound those not wearing the “old school tie” or those seeking their advocacy. It’s all a form of elitist fraternity mandating the people must stand in awe of their self-elevated grandeur – witness the two prime movers of this discourse. We honor them because it’s traditional to do so.

We need lawyers to speak to judges. Judges speak to lawyers. Lawyers tell us what they think is correct, no matter how wrong they are, then debate the issue in court. The winning lawyer gets paid and the losing lawyer gets paid (unless there’s a prior agreement to hold the client blameless for expenses –good luck with that).

This is a case of the stupid mapping a course through a minefield for the blind to follow.

It’s why the Supreme Court focuses separately to navigate the dangers engineered by logically challenged national leaders.
